Court debt collection

Protect your claim in court when an agreement is not enough.

We help choose a suitable procedure, prepare documents and represent the creditor. We start by assessing evidence, objections, costs and the prospect of actual recovery.

Request an assessment ↗

The service

How can we help?

01

Payment-order procedure

We assess whether the claim qualifies and prepare the application. If the debtor objects, we explain the next options.

02

Civil claim and representation

We prepare the statement of claim, organise evidence and consider a settlement during proceedings.

03

Interim relief

If future enforcement may be at risk, we assess an application to secure the claim and its supporting grounds.

When a customer does not pay

When should a debt go to court?

If reminders and payment promises fail, or the debtor disputes the invoice, court proceedings may resolve the claim and produce an enforceable decision.

Before filing, we examine documents, possible objections, limitation, the debtor's ability to pay and whether the likely recovery justifies the cost.

If there is a credible risk of assets being removed or sold, we also assess interim relief.

Out-of-court collection ↗

Choosing a route

Payment order or civil claim?

The choice depends on the amount, basis and whether the debtor disputes the claim.

Payment-order procedure

For a qualifying due monetary claim of up to €8,000 including ancillary claims. Ancillary claims must not exceed the principal. The application is electronic and generally does not involve a hearing.

If the debtor objects, the case may continue as a civil claim unless the applicant requested termination.

Application: €69 + VAT ↗

Civil claim

Used when a claim does not fit the payment-order procedure or needs substantive consideration of evidence and objections.

We prepare the statement and supporting documents. Further representation and additional steps are agreed separately.

Statement of claim: €350 + VAT ↗

From claim to payment

The goal is money received.

Going to court is one step. We consider from the start how an enforceable outcome could lead to payment.

01 / Assess

Claim and evidence

Review documents, objections and costs; choose a procedure and consider interim relief.

02 / Resolve

Agreement or judgment

Submit the claim and remain open to a payment arrangement or settlement agreed with you.

03 / Continue

From decision to enforcement

If the debtor does not comply voluntarily, we help move towards enforcement. Actual recovery depends on assets and income.

Payment-order state fee: 3%, at least €65

3% of the total claim, minimum €65. For example, €65 on a €1,000 claim and €150 on a €5,000 claim. An apartment association pays €25 regardless of the number of claims. The claim may be up to €8,000 including ancillary amounts, which cannot exceed the principal.

Interim-relief state fee and possible security

The application state fee is €70. Kreedix's service fee is €160 + VAT, making €268.40 including the state fee. For a monetary claim, a deposit of 5% of the amount, at least €32 and at most €32,000, is generally required under the rule valid through 2026. The calculator shows it separately.

From 1 January 2027, the minimum deposit becomes €500 and the maximum €100,000; the 5% rule remains. The court decides the actual deposit and its release. Legal basis ↗

Who pays court costs, and what if the debtor objects?

The applicant initially pays the state fee. The court decides the final allocation. In payment-order proceedings, €20 is provided towards the applicant's costs; full representation fees cannot be assumed recoverable. An objection may lead to a civil claim, additional preparation costs and an additional state fee.

Frequently asked questions

Before going to court.

Can the claim be proved? What will proceedings cost? Does the debtor have assets? These questions help choose a sensible next step.

Discuss your claim ↗
Does my claim qualify for a payment order?

A qualifying due monetary claim may total up to €8,000 including ancillary claims; those must not exceed the principal. We also check the basis and other requirements.

What if the debtor objects?

An objection does not itself prove the claim unfounded. The case may continue as a civil claim unless the applicant requested termination. We agree further costs first.

How long does a court case take?

There is no fixed period. Service, objections, evidence and the court's schedule matter. Enforcement may follow the decision.

Can I claim without a signed contract?

Sometimes. Orders, emails, delivery records or payments may support the agreement and performance. An invoice alone may not suffice in a dispute.

Can I recover the state fee and legal costs?

The court decides allocation and recoverability. A payment-order case provides €20 towards applicant costs in addition to the state fee; full legal representation cannot be assumed recoverable.

Can we settle during proceedings?

Yes. We can agree payment amounts, dates and costs. Kreedix's settlement service costs €160 + VAT.

What if the debtor sells assets?

Tell us promptly. We assess interim relief, its state fee and possible court-ordered security deposit.

I have a judgment but no payment.

An enforceable judgment can be submitted to a bailiff. See enforcement proceedings.
