Enforcement proceedings for creditors

You have a judgment. How can it become a payment?

If the debtor does not comply with an enforceable document, we help prepare an enforcement application and monitor the case. These Kreedix services are free for our clients. A bailiff carries out compulsory enforcement.

Ask for enforcement help ↗

Before applying

An invoice alone is not enough.

Enforcement requires an enforceable document, such as an effective or immediately enforceable judgment, payment order or notarial agreement consenting to immediate enforcement. An invoice, contract or reminder alone is not such a document.

If you do not yet have one, we assess a payment order or civil claim. If you do, we check the outstanding balance and next steps.

Kreedix help

From enforceable document to bailiff case.

A judgment does not itself mean money has arrived.

01 / Check

Balance and documents

We review the enforceable document, debtor information and payments already received.

02 / Apply

Application to a bailiff

We prepare a signable application and attachments. The choice of bailiff depends on location and assets.

03 / Follow up

Progress of the case

We track information and payments and help pass relevant details to the bailiff. The bailiff decides and carries out enforcement measures.

Alongside enforcement

Is the eligible company debt visible in Inforegister?

If the debtor has no money or assets, a bailiff may not recover the claim immediately. If publication conditions are met, we recommend considering payment-default publication in Inforegister as an additional step.

Visibility in business background information may encourage payment or an agreement. Publication cannot guarantee recovery.

Our help costs the client

€0

Kreedix charges its client nothing for preparing the enforcement application and monitoring the case. Statutory bailiff fees are separate and are generally borne by the debtor.

A bailiff may nevertheless request an advance on fees or enforcement costs from the creditor. A fee advance is returned if the bailiff recovers the full fee from the debtor; it is generally not returned if the case closes without recovery. Withdrawal may create further costs.

Bailiff fee calculator

What might enforcement cost?

Enter the monetary claim. The calculator separates the statutory main fee, initiation fee and possible creditor advance.

Estimated calculation

Bailiff main fee for debtor, with VAT
–
Initiation fee for debtor, with VAT
–
Total bailiff fees for debtor, with VAT
–
Possible advance from creditor, with VAT
–

An advance is a possible temporary outgoing amount, not a third fee added to the debtor's total. Actual expenses and additional fees depend on the work performed.

For an ordinary monetary claim. Special rules may apply to mortgage-secured claims over €150,000, maintenance, non-monetary claims and specific measures. Partial recovery reduces the main fee proportionately. The bailiff determines the final fees and advance. The calculator adds 24% VAT. Bailiffs Act §§ 30–35 ↗

How do I start enforcement?

Submit a signed application and enforceable document to a bailiff, stating the current balance. We help prepare both.

How do I choose a bailiff?

Location of the debtor and assets matters. See the official bailiff contacts.

Who pays bailiff fees?

Usually the debtor, but a statutory advance may be requested from the creditor. See the calculator.

Does a judgment guarantee recovery?

No. Recovery depends on assets and income. A bailiff can continue looking for enforceable assets within the applicable rules.

Can I agree a payment schedule?

Yes. Tell the bailiff and ensure payments and the remaining balance are updated. Under the statutory conditions, proper fulfilment of a timely schedule can reduce the bailiff's main fee.

What if the debtor pays me directly?

Notify the bailiff and Kreedix immediately so the same amount is not collected twice.
