1. Parties and scope
The service provider is KREEDIX OÜ, registry code 11043745, address Tähe tn 129b, Tartu, 50113 (Kreedix). The Client is the creditor ordering credit management or debt collection services.
These general terms are intended for Clients acting in a business or professional capacity. Terms for a consumer Client are agreed separately, taking account of their statutory rights. The debtor may be a company or a private individual; the debtor does not become a party to this service agreement.
These terms apply if the parties agree to their application. Specific terms in the service agreement take precedence, and mandatory legal requirements apply in all cases.
2. Services and starting cooperation
Kreedix provides credit management and debt collection services: customer background checks, portfolio monitoring, reminders, communication with debtors, payment agreements and monitoring their fulfilment. Where justified, services may include transmitting payment-default information to Inforegister and Storybook.
Before work starts, the parties agree the scope, authority to represent the Client, workflow, billing and specific terms in a form reproducible in writing. Court proceedings and international claims require a separate agreement.
For a new client, the service agreement is concluded and the power of attorney granted by digital signature during claim submission. Existing clients submit claims under their valid service agreement and power of attorney. No new service agreement is concluded if signing is cancelled or fails. Before collection starts, Kreedix verifies any existing-client declaration submitted without signing in and the validity of the agreement. Submitting claims does not automatically publish a payment default.
3. Conditions for submitting a claim
A claim submitted for collection must be at least 14 days overdue and have a principal of at least €20. The Client submits only truthful, verified claims that, to their knowledge, are undisputed.
The Client supplies documents showing the claim's existence and enforceability: as applicable, the contract, invoices, due dates, outstanding balance, known payments and relevant correspondence. The Client also identifies the basis for late-payment interest and any known objections or disputes.
These conditions concern handing over a claim for collection. Preventive credit management may begin before an invoice falls due. The 14-day submission threshold is not automatic permission to publish payment-default information.
4. Credit management terms and workflow
At the start, we agree the customer portfolio, data exchange, contact channels, frequency of activities and limits for agreements with customers. The work relies on the Client's up-to-date receivables ledger and payment information.
- Portfolio review. The Client supplies receivables and unpaid-invoice data through the agreed channel. A weekly review is the normal basis unless otherwise agreed.
- Risks and next actions. Background information, credit scores, recommended credit limits and monitoring support decisions on which customers and invoices to address.
- Reminders and contact. We send agreed letters and contact customers by phone or AI-supported calls. A credit manager handles negotiations and matters requiring substantive review.
- Payment agreements. A payment schedule or other solution must stay within the authority agreed with the Client. We monitor fulfilment and report breaches.
- Reporting. The Client receives an overview of contacts, responses, payments, agreements and next actions.
If a dispute arises or a claim needs collection, court or international proceedings, the next steps and costs are agreed with the Client before that service begins.
5. Collection and payment agreements
Kreedix checks the submitted information and documents, then contacts the debtor to explain the claim and seek payment. The debtor may request supporting documents, raise objections and propose a payment arrangement.
A company payment agreement can be signed through Inforegister. For a claim against a private individual, an objection or an individual solution, contact Kreedix. The payment destination and procedure are stated in the demand or payment agreement.
A company's payment default is not shown in our public view while a signed agreement is being fulfilled. If the agreement is signed before publication and fulfilled in full, the claim stays out of our register's public view. This does not automatically change information in other registers.
6. Prices and fee calculation
- Out-of-court collection from a business debtor
- Kreedix's service fee is 6–14% of the principal + VAT. We first seek compensation from the debtor to the extent legally recoverable. The Client’s 6–10% service fee applies in the circumstances described in section 6.1.
- Collection from a consumer debtor
- The 6–14% rate does not apply. Compensation recoverable from the debtor is limited by § 113² of the Estonian Law of Obligations Act, as explained in section 6.3. Any service fee payable by the Client and billing terms are agreed separately before work starts; statutory debtor limits do not set the service fee between Kreedix and the Client.
- Kreedix's success fee on interest invoices
- 50% of amounts actually recovered on late-payment interest invoices + VAT.
- Credit management
- €3.90 + VAT per activity package. A package covers a call, a letter and handling a payment agreement under the agreed workflow. Volume and billing are agreed before work starts.
- Publishing a default in Inforegister
- Free for Inforegister clients; €3.90 + VAT per claim for non-clients. This is separate from submitting a claim for collection.
- Withdrawing a claim against a business debtor
- 6–10% of the original principal submitted for collection + VAT, except for the fee-free withdrawal cases in section 11. Fees already charged for the same service are taken into account in the final settlement.
- Court and international proceedings
- Separately agreed pricing. State fees, legal assistance, enforcement and foreign-partner costs are agreed before the relevant activity starts.
Claim-based collection fees
The rate for the claim amount applies to the entire principal, not progressively. Interest and other additional charges are excluded from this calculation.
| Principal | Collection fee | Client fee* |
|---|---|---|
| Up to 200 € | 14% | 10% |
| Over 200 – 500 € | 14% | 10% |
| Over 500 – 1000 € | 13% | 10% |
| Over 1000 – 3000 € | 12% | 10% |
| Over 3000 – 5000 € | 11% | 10% |
| Over 5000 – 10 000 € | 10% | 10% |
| Over 10 000 – 20 000 € | 9% | 9% |
| Over 20 000 – 50 000 € | 8% | 8% |
| Over 50 000 – 100 000 € | 7% | 7% |
| Over 100 000 € | 6% | 6% |
Collection minimum: €40 before VAT. VAT: 24%. Each upper boundary is inclusive. Example: €1,500 × 12% = €180; VAT €43.20; total €223.20.
* The client fee applies only in the circumstances described in the billing and withdrawal terms.
Late-payment interest is calculated at the agreed rate stated on the invoice or in the contract. If no rate has been agreed, the applicable statutory rate is used. The success fee is based on interest actually recovered.
6.1. The Client’s 6–10% service fee
There is no upfront payment for collection from a business debtor. The standard collection fee is 6–14% of the principal + VAT. Reimbursement of collection costs is first sought from the debtor to the extent legally recoverable.
A client fee of 6–10% of the original principal + VAT applies only if the debtor has paid the principal but is subsequently deregistered or enters bankruptcy and the collection costs remain unrecovered. This may arise, for example, if the debtor is deleted from the commercial register after paying the principal and the collection costs remain unpaid. The invoice includes an account of work performed and receipts. The invoicing point and payment deadline are specified in the service agreement.
Compensation received from the debtor for the same cost is credited towards the Client's service fee. If the Client has already paid the invoice, any later recovery for that same cost is returned to the Client up to the corresponding cost they paid. The same cost is not charged twice.
The claim for reimbursement of collection costs against the debtor belongs to the creditor. Kreedix presents it as the Client's authorised representative. It transfers to Kreedix only under a separate valid assignment agreement; issuing or paying a service invoice does not transfer it.
Neither the fee agreement between Kreedix and the Client nor a paid invoice automatically obliges the debtor to pay 6–14%. The debtor's legal liability, the necessity and reasonable amount of costs, and statutory limits are assessed separately. Entitlement to compensation does not necessarily arise only after the service invoice is paid: § 128(3) also covers reasonable future costs where the other requirements for the claim are met.
6.2. Compensation from a business debtor
§ 113¹(1) of the Law of Obligations Act allows a creditor entitled to late-payment interest to claim €40 in collection-cost compensation from a debtor acting in an economic or professional capacity. Prior payment of Kreedix's invoice is not required for this fixed compensation.
A larger claim requires separate justification and evidence. Under § 113¹(2), damages exceeding late-payment interest and the €40 fixed compensation may be claimed where a damages claim exists. The requirements of § 115(1), § 127 and § 128(3) must also be considered. The 6–14% is Kreedix's agreed service price, not automatic statutory compensation payable by the debtor; €40 and the service fee are not added together without justification for the same cost.
6.3. Collection costs for a consumer debtor
§ 113² of the Law of Obligations Act applies where a creditor acting in an economic or professional capacity collects a contractual debt from a consumer. A consumer is a natural person transacting outside an independent economic or professional activity. The legal basis for other claims against natural persons is assessed separately.
While the contract remains in force: up to €5 may be charged for one paid reminder per obligation that has fallen due, provided at least one free reminder was sent first. Statutory adjustments apply for joint and several debtors or security providers.
| Creditor's claim | Total compensation cap | Paid reminder letters |
|---|---|---|
| Up to €500 | Up to €30 | First: up to €15; second and third: up to €5 each |
| Over €500 up to €1,000 | Up to €40 | First: up to €20; second and third: up to €5 each |
| Over €1,000 | Up to €50 | First: up to €25; second and third: up to €5 each |
These are upper limits, not automatic fees. Charges must relate to justified collection costs for actions performed. The total cap does not entitle anyone to add the unused balance automatically on top of letter fees. Costs previously claimed and paid under the same contract are also taken into account; handing a debt to a collector does not restart the limits. The adjustments in § 113²(2) apply for joint and several debtors or security providers.
The first paid reminder may be sent no earlier than 7 days after the contract ends. The second and third may be sent no earlier than 7 days after the previous letter. Referral to debt collection alone does not terminate the original contract.
Under § 113²(4), damages above the limits may be claimed only in exceptional circumstances, such as unusually complex collection actions, and only for justified loss exceeding late-payment interest and the statutory compensation. This is not a routine percentage fee. Consumers may request a reduction under § 113²(5); an agreement derogating to their detriment is void under § 113²(6). A service invoice to the Client or assignment does not remove these protections.
EVUL membership and the “Trusted Partner” trust mark are free for Kreedix credit management clients. Receiving and using the mark requires compliance with EVUL's conditions.
7. Client duties and liability
The Client confirms their authority to submit the claim and is responsible for the accuracy, completeness and currency of the information and documents supplied. The Client must not submit paid, non-existent or knowingly incorrect claims.
The Client promptly informs Kreedix of direct payments, settlement, set-off, changes to the claim, debtor objections and any other matter affecting collection. Agreed data exchange must help prevent further demands for sums already paid.
The Client compensates Kreedix for proven damage causally connected to false information or concealment of material information, to the extent and under the procedure provided by law.
8. Kreedix's duties and authority
Kreedix acts diligently in the Client's interests, checks the circumstances of the claim and keeps records of activities and information received. A Client's confirmation does not replace Kreedix's duty to check whether processing and publication are permissible.
The scope of authority, permitted payment schedules and any concessions are agreed with the Client. Waiving principal, starting court proceedings or incurring new external costs requires a separate agreement.
Kreedix does not guarantee recovery. Results depend, among other things, on supporting evidence, the debtor's ability to pay and fulfilment of agreements.
9. Data, publication and debtor rights
In the public claim view in Inforegister, Kreedix is shown as the creditor's representative. The creditor's name is not shown in that view. Kreedix handles communications about the claim, supporting documents and payment agreements.
This does not restrict the debtor's statutory right to information about the claim and creditor, to raise objections or to use other legal remedies.
Publication does not follow automatically from submitting a claim. The claim and data are checked, and the legal basis and proportionality of publication are assessed before publication. An objection triggers a further review of the claim and the basis for publication.
Separate conditions apply to disclosing a private individual's debt information to assess creditworthiness. In particular, disclosure for that purpose is not permitted before 30 days have passed since the contractual breach, and legitimate interests must be weighed against individual rights. The 14-day collection-submission threshold is not a publication deadline for personal data. Personal data is disclosed only for a permitted purpose and with a legal basis.
See the privacy policy and the Estonian Data Protection Inspectorate's guidance on payment-default data.
10. Confidentiality
The parties keep non-public business secrets, supporting documents, personal data and individual contract terms confidential. Published general terms and price information are not confidential.
Confidentiality does not prevent giving the debtor information needed to handle the claim, lawfully transmitting payment-default data to a register or providing information to a court or competent authority. Information is shared only to the necessary and permitted extent. Confidentiality continues after termination.
11. Duration, termination and changes
The service agreement is open-ended unless otherwise agreed. Either party may terminate it on one month's notice in a form reproducible in writing. Statutory rights to terminate for good cause remain available.
If the Client withdraws an accepted claim against a business debtor or unilaterally ends its collection, the withdrawal fee is 6–10% of the original principal submitted for collection + VAT. Fees already charged for the same service are taken into account in the final settlement. This 6–10% withdrawal fee does not apply to claims against consumer debtors; any Client fee is agreed in the specific terms.
Withdrawal is free if the debtor company is in liquidation or bankruptcy.
On termination, the parties clarify pending claims, payments, document handover and the final account. Termination does not extinguish obligations already incurred.
Kreedix may change its price list by giving the Client at least 14 days' notice. Changes do not apply retroactively to fees already calculated. Changes to specific terms of an existing service agreement require the parties' agreement.

The parties first seek to resolve questions and disputes through negotiations. Estonian law applies. Where a jurisdiction agreement is legally permitted, disputes arising from the agreement are heard by Tartu County Court. Mandatory rules on jurisdiction remain unaffected.
The services are subject, among other legislation, to the Estonian Law of Obligations Act. Specific terms for handling a claim are recorded in the service agreement.
